Rae CidiVist was arrested by the police on suspicion of possession of a controlled substance. CidiVist was informed of her Miranda rights, but not of the fact that an attorney retained by her ﬁancee was trying to contact her. This latter fact was known by the police. Right to fair hearing is one of the fundamental right entrenched in the constitution of a country. In the right ,a suspect will be given the right to defend himself or herself in the court of law. The suspect had the right to remain silent when the police are interrogating the suspect, untill the suspect sees his attorney because anything the suspect said may be used against him or her in the court of law. The suspect had the right to secure the services of an attorney, if the suspect cannot provide for one then the state will provide one for the suspect. All these are done with a view to ensure that a suspect is given the right to fair hearing. This was the basis of Miranda right.
