The assumption here is the the beverage is alcoholic. As you drink the beverage, the alcohol will take affect and slowly your judgment will become impaired. the driver may not even realize it until after getting into an accident. Usually beverages do not make people's hands greasy and there is no law against eating while driving. Also swallowing more than intended can happen to people whether or not they are driving.
