In 1984 Gregory Lee Johnson set fire to the American flag in Dallas, Texas in protest of policies by the Reagan administration. Texas at the time had a law that criminalised flag desecration and he was charged and convicted under this law.

When the case reached the Supreme Court, Justice Brennan was of the opinion that allowing the destruction of the flag symbolized the protection of freedom enshrined in the Constitution and people not liking the medium of protest was no reason for that to change.
