First, it is correct to state that the US constitution is not yet final and may never be.

It may be argued that the Federal Government does not have little powers however it does cede lots of power to the state as well as to the congress.

For example, according to the U.S. Constitution, Congress has the authority to control trade between the several states and with other countries.

In combination with the Necessary and Proper Clause, this authority today offers one of the widest bases for the exercise of legislative power and has been recognized as the legal foundation for a considerable number of the legislation made by Congress during the past 50 years.

However, the Supreme Court did query the degree to which Congress might invoke the Commerce Clause as a justification for federal jurisdiction in United States v. Lopez and related decisions.
