Schenek protested the US entry into World War I by standing in public areas and handing out pamphlets encouraging citizens to stay out of the war and not to participate.

The Supreme Court ruled Schenek was not protected by free speech because his actions hurt the security of the US. This case set the precedent that a person could not use the First Amendment to protect speech or rights to assembly if their actions could be viewed as a security risk. Because he was encouraging people to not sign up for war during a time of war, it was viewed as a threat to US security.

Congress wanted to promote national duty among citizens of the country and wanted involvement of its people during the period of World War 1 as to do this, The congress enacted number of laws which were severely restricting the first amendment freedom to curb the antiwar dissent. During this series of laws, Congress passed Espionage Act, this act set stiff penalties to the people who circulated false statements which were intended to stall or interfere in American war efforts in regards to World War 1. During this period of time, Charles Schenck, who was general secretary of the Socialist party of America, The thinking of the socialists was that the war will provide benefit only to the wealthy and rich people and only people from poor class will suffer with deaths and wounds fighting in Europe. They not only opposed the war but also urged people of United States to oppose war as well.  The antiwar policy of socialist party was seen as the violation of Espionage act and because of this, Charles Schenck was arrested on the charges of causing insubordination in military and naval forces of the United States.
