A person is arrested for having possession of a handgun. The suspect argues in trial that people have the right to carry handguns based on the Second Amendment.

The Second Amendment to the U.S's Constitution (December 15, 1791) states the following:

"A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

The District of Columbia v. Heller Case's decision (2008), also affirmed it. The case decided that based on the Second Amendment, an individual has the right to possess a firearm unconnected with service in a militia, and to use the arm for traditionally lawful purposes, such as self-defense within the home.
