Mitigation of damages is a nonbreaching party's legal duty to avoid or reduce damages caused by a breach of contract. This means that the injured party has a duty to take care, to work, to prevent that any further damages might occur. If someone is hit by a car unjustly, and his leg is injured, then, he must not further use his leg to its detriment. In the case of a breach of contract, the injury can be physical, monetary, or of a real property substance.
